Allegations of fraud have been raised against Mozzat Ali, also known as Morzet Ali, of Alampur village under Alampur Union in Kushtia Sadar, after he reportedly filed a court case over a piece of land months after selling it, receiving payment, and completing the official registration process. The incident has created widespread discussion in the area.
According to local sources and on-site investigations, the original owner of 66 decimals of land under Dag No. 3161 of RS Khatian No. 497 in Alampur Mouza, Kushtia Sadar, was Shafi Ullah Mia. On March 20, 1989, through registered deed No. 2523, he sold the land to Mohor Ali Mondol and Mozzat Ali Mondol. Later, in 2001, the two brothers officially recorded the land in their names through mutation.
On April 30, 2005, due to personal issues, Mohor Ali Mondol sold his 33 decimals share to his brother Mozzat Ali Mondol. However, instead of registering the property in his own name, Mozzat Ali registered it in the name of his wife, Machiron Nesa.
After the death of Machiron Nesa, ownership of the land was inherited by her husband Mozzat Ali and their only son, Sarowar Hossain. Due to financial hardship and bank loan pressure, Sarowar Hossain later decided to sell his 24.75 decimals share of the property.
Sources say that Jahurul Islam Tarek, son of the former owner’s family member Mohor Ali Mondol, expressed interest in purchasing the land. The negotiations and coordination between both parties were reportedly handled by Akram Hossain, the younger son of the late Jamal Uddin Mondol, who is a cousin to both sides.
It has been alleged that Mozzat Ali personally received the initial advance payment of BDT 20,000 for the sale agreement. Later, Sarowar Hossain received an additional BDT 100,000, which was reportedly used to repay a loan at Bangladesh Krishi Bank, Kushtia Branch. Loan officer Shamim Hossain has been mentioned as a witness to the transaction.
Fifteen days after the loan repayment, the land documents were released from the bank, and on May 14, 2024, Sarowar Hossain officially registered the land in the name of Jahurul Islam Tarek’s wife at the Kushtia Sadar Sub-Registry Office. Local businessman Golam Mowla and Akram Hossain were reportedly present during the registration process.
However, the situation took a dramatic turn on September 5 of the same year. Several months after the sale and registration, Mozzat Ali Mondol filed a pre-emption case in the Senior Judge Court of Kushtia. The case was registered as Case No. 68/24.
Speaking about the matter, Jahurul Islam Tarek, Senior Member of the Dhaka Union of Journalists, Editor of the national weekly Consumer Voice, and Managing Director of BMF Television, said:
“Before purchasing the land, I spoke with my uncle Mozzat Ali several times. He personally accepted the initial advance payment and repeatedly told me, ‘The land is staying within the family.’ Yet now, he himself has filed a case against me.”
He further added:
“My cousin Sarowar Hossain was under severe pressure due to bank loans. To help him avoid legal complications and financial crisis, I broke my fixed deposit before maturity and suffered financial loss to purchase the land. Now, even after buying it legally, I am being forced to face a lawsuit.”
Attempts to contact Sarowar Hossain were unsuccessful, as his mobile phone was found switched off. Meanwhile, repeated calls to Mozzat Ali, the plaintiff in the case, also went unanswered.
Local residents allege that filing a lawsuit after being directly involved in the sale process is unethical and fraudulent. They have demanded a fair investigation and necessary legal action regarding the matter.
